Bands And Body, Inc Contract

LIABILITY

Client represents that he/she is in proper physical condition to start an exercise and diet program. Physical activity, by its very nature, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. I, the client, being aware of my own health and physical condition, and having knowledge that my participation in any exercise program could lead to injury, am voluntarily participating in physical activity with Bands And Body and release Bands and Body, Inc from liability for accidental injury, illness or death. I also understand that personal fitness training may require physical contact from the personal trainer to prevent injuries and therefore I will not sue or prosecute Bands And Body inc for sexual harassment.

TARDINESS

Client understands that sessions are structured in a way that will enable the most amount of benefit in the shortest amount of time (45min), and therefore must ensure sessions always start on time.

CANCELLATION POLICY

Due to the nature of providing an appointment based service, it is extremely important to maintain set appointments. If, however, you are not able to keep an appointment time, notification must be made at least 24 hours in advanced.

SESSION ROLLOVERS

If, however, a cancelled appointment cannot be made up for any reason a contract extension can be made and the appointment can be rolled over to a future week.

EARLY TERMINATION

Client understands that all contracts terminated before their fulfillment, will be held accountable for any promos and pro-rated months plus an additional cancellation fee of $100.00.

REFUND POLICY

Client agrees that all sales are final. Plans can be put on hold for a total of 30 days unless written documentation is provided by a professional stating specifically that exercise must be discontinued for longer.

ACKNOWLEDGMENT OF UNDERSTANDING

I, the client, have read this assumption of risk and fully understand its terms.

I acknowledge that I am signing freely and voluntarily and intend my signature to signify a complete assumption of the inherent risks of participating or observing recreational activities with Bands And Body, Inc to the greatest extent allowed by law in the State of California. I agree to the foregoing service agreement and this contract shall constitute the entire agreement between Bands And Body, Inc and myself.
